Who Are LEPs?

There are two groups of LEPs:

1. Persons with some degree of hearing loss and who communicate primarily through a sign language.

2. Persons whose mother tongue is a language other than English and communicate primarily or exclusively through a spoken language other than English.

​

Even though they may know some English, they are unable to either speak or understand it sufficiently to meaningfully participate in legal contexts.

WV Human Rights Act - WVHRA

WVHRA prohibits discrimination in employment and in places of public accommodations based on race, religion, color, national origin, ancestry, sex, age (40 or above), blindness, or disability.

Harry M. v. Department of Public Welfare (Pennsylvania, 2013)

Plaintiff Harry M. filed a class action lawsuit on behalf of himself and all people who, now or in the future, are Deaf and enrolled in Pennsylvania’s Consolidated Waiver (“class members”), against the Department of Public Welfare ("DPW").  The Plaintiff claimed that DPW is violating Deaf class members’ federal rights because services are not being provided with effective communication. The settlement agreement included the identification of individuals covered under “class members” and to provide communication assessments to them by trained individuals. It also included the hiring of a Deaf Services Coordinator who is responsible for advising the Department of Public Welfare on Deaf issues, finding qualified providers, providing technical assistance to providers, the continued provision of appropriate services offered to Deaf individuals.
